REGISTRATION OF DOCUMENTS IN DELHI

Under the Registration Act, 1908, certain documents are required to be registered compulsorily and certain documents of which registration is optional.

A document which creates any right, title, claim or interest in any immovable property needs to be properly drafted covering all the material facts, circumstance, clauses and consideration because ambiguous clauses or loose drafted clauses may create confusion, misinterpretation, doubts and might leads to litigation in future.   

There are certain documents which required compulsorily registration under the Registration Act, 1908 such as:

  • Sale Deed
  • Gift Deed
  • Conveyance Deed
  • Mortgage Deed
  • Relinquishment Deed
  • General Power of Attorney given for consideration
  • Lease deed for more than one year period
  • Any other non-testamentary instruments through which any right, title or interest, is created, declared, assigned, extinguished in any immovable property of the value of one hundred rupees and upwards.
  • any other non-testamentary instruments which acknowledge the receipt or payment of any consideration on account of the creation, declaration, assignment, limitation or extinction of any such right, title or interest.

There are certain other documents which could also be registered optionally such as:

  • Will
  • Adoption deed
  • General Power of Attorney
  • Special Power of Attorney
  • Rent Agreement / Lease Deed for less than one year period.
  • Trust Deed
  • Partnership Deed

It is to be noted that the stamp duty is the state subject. And every state in India has prescribed its own rate of stamp duty and registration charges for registration of the documents.

In the National Capital Territory of Delhi, rate of stamp duty and registration charges for some crucial documents are given as under:   

For registration of Sale Deed / Gift Deed / Conveyance Deed / GPA for consideration

  • Stamp duty @ 4% if the Vendee is a woman and @ 6% if the vendee is a man.
  • Registration fee is 1% of the total consideration or market value of the property whichever is higher + Rs. 100/- pasting charge.
